Terms and Conditions

1. Introduction

Welcome to Eekaam ("Platform", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Eekaam e-commerce platform, including our website, dashboard, APIs, storefront hosting, and all related services. By creating an account or using the Platform, you agree to be bound by these Terms.

2. Definitions

• "Merchant" — any individual or business that registers on Eekaam to create and operate an online store.
• "Customer" — any end user who purchases products from a Merchant's store hosted on Eekaam.
• "Store" — the online storefront created and managed by a Merchant through Eekaam.
• "Services" — all features provided by Eekaam, including store hosting, theme editing, payment processing integration, order management, and analytics.

3. Account Registration

To use Eekaam, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Platform.

4. Platform Services

Eekaam provides a multi-tenant e-commerce platform that enables Merchants to create online stores, manage products, process orders, and accept payments. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

5. Payments and Billing

Subscription fees for the Platform are billed according to the plan selected by the Merchant. Payments are processed through our third-party payment provider (Paddle). All fees are non-refundable unless otherwise stated in our Refund Policy. We reserve the right to change pricing with 30 days' advance notice.

6. Merchant Responsibilities

As a Merchant on Eekaam, you agree to:

• Comply with all applicable laws and regulations in your jurisdiction.
• Not sell prohibited, illegal, or counterfeit goods through your Store.
• Provide accurate product descriptions, pricing, and shipping information.
• Handle customer service, returns, and disputes for your Store in a timely manner.
• Maintain valid business licenses and tax registrations as required.

7. Prohibited Activities

You may not use the Platform to:

• Sell illegal, harmful, or regulated products without proper authorization.
• Engage in fraud, money laundering, or deceptive practices.
• Infringe on intellectual property rights of others.
• Distribute malware, viruses, or any harmful code.
• Interfere with or disrupt the Platform's infrastructure.
• Scrape, crawl, or harvest data from the Platform without authorization.

8. Intellectual Property

All content, branding, code, and design of the Eekaam Platform are the intellectual property of Eekaam and are protected by copyright, trademark, and other applicable laws. Merchants retain ownership of their store content, product images, and descriptions. By uploading content to the Platform, you grant Eekaam a non-exclusive license to host and display that content as necessary to provide the Services.

9. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. We collect, process, and store data as described therein. You are responsible for complying with applicable data protection laws regarding your Customers' data.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Eekaam shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Platform. Our total liability shall not exceed the amount paid by you to Eekaam in the twelve (12) months preceding the claim.

11. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your Store will be deactivated and your data will be retained for 30 days before permanent deletion, during which you may request an export.

12. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure at all times.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these Terms shall be resolved through the courts of Karachi, Pakistan.

14. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a notice on the Platform. Continued use of the Platform after changes constitutes your acceptance of the updated Terms.
